Cases Involving Property Rights After A Death
Probate Law cases involve petitions for Probate, Guardianship, Conservatorship, Petition to Terminate Joint Tenancy, Affidavit for Real Property of Small Value, Petition to Establish Fact of Birth, Death, or Marriage. If you are involved in a Probate Guardianship or Probate Conservatorship Investigation, such investigations will be conducted through the Family Court Services.
The Probate Department is in the Civil Division at the Main Courthouse located at:

Normal window hours are 8:00 AM - 3:00 PM. The busiest hours are from 8:00 AM to 10:00 AM and from 2:00 PM to 3:00 PM. Visitors are encouraged to report to the Civil Department window no later than 2:00 PM for processing and copies of case files. A drop box will be available from 3:00 PM to 4:00 PM for filings. Note that cash payments cannot be placed in the available drop box at any time.

Local Procedures and Notes
- Ex-parte hearings are heard in Department 40, Department 44, or Department 45 and Monday-Friday at 8:00 AM. Documents along with the 24-hour Notice or Non-notice Declaration must be submitted to the courts no later than 10:00 a.m. prior to the court date.
- All documents are to be filed two (2) days prior to the court date.
- Madera Superior Court does not have a Probate Examiner on staff.
